Going through a divorce can be very emotional, expensive, and frustrating for both parties.  Whether you are filing for a fair and just division of the community properties, child custody dispute, it is important that you work with a family law attorney you can trust to protect your rights and provide you with the information you need to safeguard your family’s best interests.

In Texas, whatever money is made during the marriage, regardless of “breadwinner” status, is considered community property. Should a divorce occur, in the absence of a prenuptial agreement, assets accrued during the marriage generally are split 50-50, or sometimes a different percentage? Our attorney can prepare for you the prenuptial agreement which is designed to protect what a person brings to the marriage: any inheritance, property, savings, etc. It is equally important that you consult with our attorneys to understand your rights before you sign this document from your future spouse.

Chapter 7 Bankruptcy allows individuals to discharge most of their debts. Credit cards, loans, medical debt, some taxes, past repossessions, past rent, past utilities, and many other types of debts can be eliminated in chapter 7 if you qualify. Your income should be below a certain amount to qualify for chapter 7. Most people that file chapter 7 do not lose any of their exempt property such as homestead, retirements, 401k accounts, car, and their personal properties.

Chapter 13 Bankruptcy is a payment plan that allows individuals to reorganize debt. Chapter 13 can also help you to stop a foreclosure of your home and pay the mortgage through bankruptcy, or stop repossession of a vehicle and pay the vehicle through bankruptcy. Chapter 13 is also filed by higher-income individuals or others that might not qualify or prefer to file a chapter 13 payment plan.

Chapter 12 Bankruptcy is designed for “family farmers” or “family fishermen” with “regular annual income.” It enables financially distressed family farmers and fishermen to propose and carry out a plan to repay all or part of their debts. Debtors propose a repayment plan to make installments to creditors over three to five years.

Chapter 11 and Bankruptcy for Small Business provide for reorganization, usually involving a corporation or partnership. A chapter 11 debtor usually proposes a plan of reorganization to keep its business alive and pay creditors over time. People in business or individuals can also seek relief in chapter 11.
